Pimping
The crime of "pimping" is governed by California Penal Code section 266h. According to this section, you can be convicted of pimping when you either:
- Solicit prostitution by finding customers for a prostitute and then collecting a fee from that customer and/or some or all of the prostitute’s payment
- Collect some portion of the prostitute’s pay regardless of whether or not you played a part in finding the customer
The law defines a prostitute as anyone who engages in sexual activity for hire. Thus, one can be charged with pimping for advertising or promoting the prostitute in any manner, whether that be on a corner of a street, in a print publication, or via the internet.
Pimping Penalties in California
California prosecutes 266h charges as felonies. If convicted under California’s pimping law, one will find themselves facing:
- A sentence of between three and six years in a California state prison
- Up to $10,000.00 in fines
- A $5,000.00 special fine that is used to fund counseling centers and programs for victims of sexual abuse
When the prostitute is a minor (i.e., under the age of 16), you will also be registered as a California sex offender, a designation that lasts a lifetime. More so, the maximum prison sentence will increase to eight years.
It should go without saying that a pimping conviction will have significant repercussions on your personal and professional life.
