Pandering
The crime of pandering is governed by California Penal Code section 266i. Although very similar to California’s pimping law, there are important differences.
According to California law, one violates the state’s pandering law when one "procures another person for the purpose of prostitution by intentionally encouraging or persuading an individual to become or remain a prostitute". The law further defines procure as to "give, transport, provide, or make available".
Specifically, in order to be convicted of pandering, the prosecution must show that you:
- Encouraged or persuaded someone to engage in prostitution (regardless of whether this was via promises, threats, violence, payment, etc.), and
- Made that person available for purposes of prostitution
California defines prostitution as anyone who engages in sexual activity for hire.
Penalties for Pandering in California
The penalties for pandering are the same as for a pimping conviction, and is thus prosecuted as a felony. If conviction, one could face:
- A sentence of between three and six years in a California state prison
- Up to $10,000.00 in fines
- A $5,000.00 special fine that is used to fund counseling centers and programs for victims of sexual abuse
When the pandering involves a minor (i.e., under the age of 16), you will also be registered as a California sex offender, a designation that last a lifetime. More so, the maximum prison sentence will increase to eight years.
It should go without saying that a pandering conviction will have significant repercussions on your personal and professional life. Many people lose their jobs and find it extremely difficult to find a job after a California pandering conviction. More so, some professions that require a license or certification (such as teaching or the law) will automatically revoke your license following a conviction.
