California Man Receives Manslaughter Charges Following Overdose

Manslaughter is a crime that is often misunderstood by those who, fortunately, have never had to encounter this type of charge in their own lives. Some might assume that involuntary manslaughter charges only come about after car accidents or accidental shootings. However, a California resident can be charged with involuntary manslaughter in some cases after providing drugs to someone who later overdoses on those same substances.

A 23-year-old man from Ventura was arrested in late July for violations relating to weapons and narcotics. Police found multiple firearms in the man’s residence, as well as several homemade weapons. Authorities also found a lab for manufacturing cannabis; as a result, both the man and his 50-year-old father were arrested.

The investigation came about after a tip from the Interagency Pharmaceutical Crimes Unit for Ventura County. Back in February, according to the Ventura County Sheriff’s Department, the 23-year-old had sold heroin to a 32-year-old man. That man overdosed on February 9 at his home. He was taken to a hospital but passed away a few days later.

Officials began investigating the death and found out that the deceased man had originally purchased the drugs from the 23-year-old Ventura man. That man was arrested for selling drugs in late February, but by mid-March had obtained bail and left police custody. Once police began digging further they discovered the weapons as well.

The Ventura man is now back in police custody, facing not only involuntary manslaughter charges but also an enhancement of causing “great bodily injury or death” while dealing drugs. Both the father and son were booked at the Ventura County Jail, although the 50-year-old was eventually allowed to go home with a pending date in court.

In California, involuntary manslaughter often refers to accidental deaths that occur during the commission of another crime, or are caused by that other crime. A manslaughter charge can also stem from recklessness during an otherwise lawful activity. If convicted in his case, the Ventura man could face several years in a state prison.
